Terms and Conditions

DEFINITIONS

In these terms and conditions, the following words and phrases shall have the following meanings (and, where applicable in these terms and conditions, the singular shall include the plural):

“Auction”: The auction run by The Lamington Cake Project during the Term
“Auction Terms and Conditions”: These terms and conditions relating to the Auction
“Bid Period”: The period, during which a Participant may bid for a particular item in an Auction
“Raffle”: The raffle run by The Lamington Cake Project during the Term
“Raffle Terms and Conditions”: These terms and conditions relating to the Raffle
“Raffle Period”: The period, during which a Participant may purchase tickets in a particular Raffle
“Term”: The period of time that the auction and the raffle are active, between Friday 24th January 2020 at 00:00 to Saturday 29th February 2020 at 23:59 inclusive.
“The Lamington Cake Project”: The Lamington Cake Project is a fundraising project.
“Participant” or “you”: A person who participates in the A fuction or Raffle
“Website”: projectlamington.com

INTRODUCTION

The Lamington Cake Project is a fundraising project in aid of the Australian Bushfires.

All proceeds from the project will be split in equal amounts and donated directly to Red Cross Australia, The Salvation Army Australia, CFA (Country Fire Authority), NSW Rural Fire Service, and WIRES Wildlife Rescue upon completion of the Raffle Period and Auction Period.

AUCTION TERMS AND CONDITIONS

All auctions will take place between 24th January 2020 at 00:00 to Saturday 29th February 2020 at 23:59.

During the Bid Period each Participant must go online to projectlamington.com from where they can place their bid.

Participants must be 18 years of age or over. We reserve the right to verify the eligibility of all entrants.

Payment for an item must be transferred through Paypal or debit or credit card.

The amount to be paid, having been deducted from or charged to the Participant’s debit or credit card, shall constitute consideration. All Participants must ensure that, prior to placing a bid, they are able to pay for any item which they wish to bid for.

All matters relating to the Auction shall be at our sole discretion.

Notwithstanding that a successful bid has been received, in the event that we discover that (i) the Participant was or should have been ineligible to make a bid for an item, or (ii) that the Participant should have been declared invalid for any other reason whatever (at our absolute discretion), we reserve the right to reject the bid. In such circumstances, we reserve the right to offer the prize to the second highest bidder.

RAFFLE TERMS AND CONDITIONS

All raffles are operated as small societies lotteries, and registered with Tower Hamlets County Council, in accordance with the requirements of the Gambling Act 2005.

The Raffle is open to all Great Britain residents over the age of 16. Any person found to be under the age of 16 automatically forfeits the right to any prize.

Participation in each Raffle costs £2 per ticket and all ticket purchases are non-refundable.

Tickets for each Raffle will be able to be purchased between 24th January 2020 at 00:00 to Saturday 29th February 2020 at 23:59.

Any entries received after this will forfeit the right to any prizes and treated as a donation to the charity.

An email will be sent to each Participant confirming their ticket numbers in the draw and thanking them for their participation.

All online ticket purchases will be managed by our payment processor, Stripe. They will deduct a 2.4% fee plus 20p per transaction to cover their admin costs.

All draws will be made on Sunday 1st March 2020 and will be made in the presence of two witnesses.

The prize for each Raffle is a batch of twelve lamington cakes from the specified chef.

All Winners will be notified in writing before Tuesday 3rd March 2020, to the email submitted when donating.

RAFFLE TICKETS
A list of winning Participants will be available from The Lamington Cake Project on receipt of a stamped addressed envelope.

DELIVERY
Prizes will be available for collection from the specified chef at a date and time coordinated between the chef and The Lamington Cake Project.

The Lamington Cake Project can alternatively arrange delivery of lamington cakes.

All delivery payments must be paid in advance of delivery taking place.

When an item is delivered, risk of damage to, or loss of, the item passes shall pass to the relevant Participant.

FORCE MAJEURE
We will not be liable or responsible for any failure to perform, or delay in performance of any of our obligations under these terms that is caused by events outside our reasonable control (“Force Majeure Event”).

Our performance under these terms is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period.

RETURNS
You are responsible for inspecting any items at the time of delivery to ensure that they match the items described on the Website.

We will only accept return of the items if it can be shown that the description on the Website was substantially different from that delivered.

In limited circumstances, where you are entitled to return an item, it must be returned direct to us within 14 days of delivery/collection. Items are returned at your own cost and risk. The item will remain your responsibility until it is received by us, so we therefore recommend you return the item by recorded delivery.

ALLERGIES
We are unable to guarantee that the lamingtons are suitable for any food allergies. We are unable to provide a full ingredients list for each lamington cake and recommend that those suffering from food allergies refrain from eating the lamington cakes. The Lamington Cake Project does not accept responsibility for any potential allergic reactions to ingredients in any of the lamington cakes.

LIMITATION OF LIABILITY
All items offered for Auction shall be subject to availability and we shall not be liable for any claims, expenses, costs and/or any losses (including, but not limited to, loss of profits, indirect, pure economic and consequential losses or otherwise) or any damage (save for death or personal injury arising from negligence) suffered by any Participant.

VARIATIONS
We may revise the terms of this User Agreement at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on our Website.
